Acceptance of Terms

By accessing and using our website, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, please refrain from using our website.

Product Information

We make every effort to provide accurate and up-to-date information about our products. However, we cannot guarantee the accuracy, completeness, or reliability of any product descriptions, pricing, or availability displayed on our website. We reserve the right to update or modify product information at any time without prior notice.

KYGUNCO retains the right to refuse any order which includes, but is not limited to, online listings containing errors in title, description, or price. Should an order be canceled, the customer will be contacted, and the customer's payment will be refunded. If an order is shipped by mistake, the customer should return the item unopened to avoid billing. In placing an online order, the customer agrees that any discrepancies will be ultimately judged by KYGUNCO.

Email Communication

By creating an account or placing an order, you authorize KYGUNCO to send you follow-up emails related to your purchase, as well as promotional emails. You may unsubscribe at any time. We are not responsible for any pricing errors in our communications.

Age and Legal Compliance

By placing an order on our website, you confirm that:

You are at least 21 years of age or the legal age to purchase firearms, ammunition, or other products in your jurisdiction.
You understand that it is your responsibility to comply with all applicable laws and regulations regarding the purchase, possession, and use of our products.
You are not under indictment for, nor have you been convicted of, a crime punishable by imprisonment for over one year.
You are not a fugitive from justice.
You are not an unlawful user of, or addicted to, any controlled substance.
You have not been adjudicated as a mental defective or committed to a mental institution.
You are a legal U.S. citizen or a lawful permanent resident.
You have not been discharged from the Armed Forces under dishonorable conditions.
You are not subject to a domestic violence restraining order.
You have not been convicted of a misdemeanor crime of domestic violence.
You will not engage in unauthorized export of defense articles.

If any of the above statements are untrue, you agree to release, hold harmless, indemnify, and defend KYGUNCO, its owners, agents, officers, and employees against any damages, including legal fees, civil liability, or criminal prosecution.

Payment

We accept Visa, Discover, Mastercard, and Credova. By providing your payment information, you authorize us to charge the total order amount to the selected payment method. Prices listed on our website are in US dollars and are subject to change without notice.

We can accept cashier checks, certified checks, and money orders** mailed to our physical address (401 Glenwood Drive, Bardstown, KY 40004) after an order is placed via phone. These payment types are NOT accepted for online orders.

We also have a layaway program.

Key Layaway Terms

Eligibility: Layaway is available for firearms only.
Down Payment: A 30% non-refundable down payment is required.
Term: You have up to 90 days to complete the payment.
Payments: Make payments anytime through your online account.
Non-Completion: If not paid in full within 90 days, the 30% down payment is forfeited.

Shipping and Delivery

We strive to process and ship your orders promptly. Shipping times may vary depending on the destination and the availability of the product. Please refer to our Shipping Policy for more information on estimated delivery times and any applicable shipping fees.

Returns and Exchanges

We want you to be completely satisfied with your purchase. If you are not happy with your order, please contact our customer service team within 7 days of receiving your shipment to initiate a return or exchange. Returned products must be in their original packaging and in new, unused condition, subject to our Return Policy.

Limitation of Liability

KYGUNCO is a retailer of third-party products and is not responsible for product performance, safety, or manufacturer warranties. You acknowledge that product manufacturers are the best resource for product safety and usage information. By purchasing from KYGUNCO, you agree to indemnify and hold us harmless from any claims related to product use, storage, or transportation.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of Kentucky. Any disputes arising out of these terms shall be resolved in the state or federal courts located in Kentucky.

Class Action Waiver

All legal disputes with KYGUNCO must be handled individually and not as part of a class action lawsuit. You acknowledge that you waive your right to bring claims as part of any group or representative action.

Reporting Illegal Activity

If you suspect illegal firearms or ammunition activity, please contact the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) at 1-800-ATF-GUNS or ATFTips@atf.gov. Reports may be submitted anonymously.

Incoming Firearm Transfers

At KYGUNCO, we make the firearm transfer process easy, safe, and enjoyable. Here are the clear and straightforward terms for firearm transfers:

Transfer Readiness

Preparation Time: Your firearm transfer will be ready within 48 business hours after delivery.
Notification: We will call you once your firearm is ready for pickup. Please wait for our call; arriving early may result in delays.

Documentation

ID Requirement: Firearms will only be released to the individual(s) named on the transfer paperwork. We cannot release the firearm to anyone whose name is not listed.

Fees

Non-NFA Items: $30.00 per item.
NFA Items: $50.00 per item.

Mobile Terms of Service

The KYGUNCO mobile message service (the "Service") is operated by KYGUNCO (“KYGUNCO”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to KYGUNCO’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of KYGUNCO through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with KYGUNCO. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other KYGUNCO mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

KYGUNCO Terms of Purchase Summary

These Terms apply to all sales between you (the seller) and KYGUNCO (the buyer), initiated via www.kygunco.com. We may update the Terms at any time, so please review them before each sale. If you do not agree with the current Terms, do not proceed with the sale.

1. Seller Representations and Warranties

By selling to us, you confirm that:

You are a U.S. citizen or lawful permanent resident, age 21+, and the sole legal owner of the Products.
You are not prohibited from selling the Products and are not under indictment for a serious crime.

The Products:

Comply with all federal, state, and local laws.
Are not NFA-regulated items (e.g., machine guns, SBRs, silencers).
Have intact serial numbers, are not defective, and are unloaded without ammunition.

Your provided address is accurate.
You have followed our shipping and packing instructions exactly.

2. Shipping and Delivery Options

You may ship the firearm yourself, in which case you are responsible for all shipping costs.
If KYGUNCO provides a shipping label, the cost of the label will be deducted from your final payment.
Alternatively, you may bring your firearm to one of our retail locations for inspection and processing, which may help avoid shipping costs and delays.

3. Inspection, Acceptance & Rejection

Our offer to buy is contingent upon inspection:

If accepted: We will pay the agreed price (minus any fees) within 3 business days. You are responsible for any taxes. Ownership transfers to us upon acceptance.
If rejected: We will notify you by email and offer to return the Products.

Important:

Do NOT ship loaded firearms or include ammunition. Violations incur a $150 Handling Fee and potential additional charges. This fee may be deducted from your payment or invoiced separately. Unpaid Handling Fees after 90 days also result in forfeiture of the Product.

The Handling Fee does not limit our right to seek further damages or remedies.

4. General Terms

You are responsible for legal compliance regarding your Products.
Never ship loaded firearms or combine firearms with ammunition.
KYGUNCO’s maximum liability is limited to the purchase price. We are not liable for any indirect, incidental, or special damages.
Notify us immediately if your address changes.
We may verify your identity using third-party services.
Promotions (e.g., giveaways or contests) are subject to additional terms available on the Site.
These Terms can only be modified in writing by you and an authorized KYGUNCO representative.
